Terms and Conditions

1. Acceptance of the Contract
These Terms and Conditions (hereinafter referred to as “Terms and Conditions”) govern the navigation and proper use of the site duplika.com (hereinafter the “Website”) by any person who accesses and/or uses the Website and/or registers as a client of DUPLIKA (hereinafter the “User”). These Terms and Conditions are mandatory and binding for the User and constitute a Contract between the User and the responsible parties of DUPLIKA INTERNET SOLUTIONS (hereinafter “DUPLIKA”).
The acceptance of these Terms and Conditions implies that the User has read and understood them. If the User does not agree with these provisions, they must refrain from using and accessing the Website and its contents, as well as from using the services provided by DUPLIKA.

2. Absence of Commercial Relationship
Acceptance of these Terms and Conditions shall not be interpreted as a license, partnership, agency, mandate, service lease, or any other type of relationship between the User and DUPLIKA.

3. Validity of the Contract Clauses
If one or more clauses of these Terms and Conditions are declared null and void by any competent authority or jurisdictional body, such nullity shall not affect the validity of the remaining clauses, which shall remain fully in force and effect.

4. Modification of the Contract
These Terms and Conditions may be modified or replaced at any time at the sole discretion of DUPLIKA. Modifications will take effect seven (7) days after their publication on the Website and/or after DUPLIKA directly communicates them.
Use of the Website by the User after this period will constitute express acceptance of the modifications. Therefore, the User is responsible for reviewing the Terms and Conditions each time they access the Website to check for updates. If the User disagrees with the modifications, they may cease using DUPLIKA’s services and/or cancel their Website registration.

5. Services Provided by DUPLIKA
DUPLIKA is an Internet solutions platform that allows Users to contract the following services:
a) Individual Hosting Plans to host a website with state-of-the-art hardware and 24/7 professional support;
b) Multi-Account Hosting for Users wishing to resell hosting services or host multiple websites with independent management;
c) Cloud Hosting to develop flexible and scalable applications on fast and secure servers, increasing capabilities as needed;
d) E-mail Marketing, a set of tools to create communication pieces quickly, send them to subscribers, and analyze results; and
e) Domain Registration, allowing Users to register domain names.

6. Legal Capacity
DUPLIKA’s services can only be used by individuals with the legal capacity to contract and by representatives of legal entities authorized under current law to contract on their behalf.
The Website services are not available to individuals without legal capacity, minors, or any DUPLIKA User who has been disqualified from using the Website.

7. Activation and Termination of Services
Service activation occurs upon confirmation of payment, made in advance for periods specified in the service contract. Upon expiration, Users have up to fifteen (15) additional days to renew services. If payment is not made within this period, DUPLIKA reserves the right to suspend the service.
After thirty (30) days from the invoice due date, DUPLIKA will add a 2% late interest charge per month, not less than ARS $10 (ten Argentine pesos). After fifty (50) days, DUPLIKA reserves the right to delete all User information hosted on its servers without liability for data loss.
DUPLIKA also reserves the right to accept or reject service requests, as service activation implies access to a privately-owned network.

8. Refunds
The User may request service cancellation and a refund within thirty (30) days of activation. Payment method commissions and domain registration costs are excluded from the refund.

9. Modification of Services
DUPLIKA reserves the right to modify service characteristics and prices. Notices affecting technical characteristics will be posted on www.duplika.com.
While DUPLIKA may change prices at any time, prices agreed upon at contract time are guaranteed for the contracted period. Terms and conditions may be modified at DUPLIKA’s discretion.

10. Responsibility
Services must be used exclusively for lawful purposes. Users are solely responsible for the content on their sites and any consequences arising from such content.
DUPLIKA is not the owner of, nor responsible for, what Users publish or offer through the services. Therefore, it does not guarantee the existence, quality, legality, accuracy, or truthfulness of User-provided information.
Users acknowledge DUPLIKA’s non-responsibility for compliance with obligations between Users regarding their content and publications.
Resellers are solely responsible for all sites or domains operated through their accounts.
DUPLIKA is not responsible for email delivery failures due to third-party filtering or blocking.

11. General Obligations of Users
Users must:
a) Use the Website responsibly, lawfully, and ethically;
b) Properly use services without affecting server performance or third parties;
c) Respect intellectual property rights;
d) Not impersonate others or submit false/misleading information;
e) Use respectful language;
f) Avoid transmitting viruses or malware;
g) Refrain from breaching Website security;
h) Not manipulate DUPLIKA’s pricing or billing structures;
i) Not host phishing or hacking-related sites;
j) Not send unsolicited mass emails (SPAM); among others.

12. Cancellation of Services
DUPLIKA may restrict, deny, or cancel services if the User violates these Terms and Conditions, applicable laws, or at DUPLIKA’s sole discretion, with or without prior notice.
Users are responsible for consequences arising from service cancellation.
DUPLIKA cooperates with legal authorities during investigations and enforcement actions.

13. Indemnity
Users agree to indemnify and hold harmless DUPLIKA, its partners, representatives, and employees from any claims or actions resulting from their actions on the Website.

14. Website Security
DUPLIKA implements security measures but does not guarantee the Website is virus-free.
Users are solely responsible for having appropriate tools to detect and remove harmful software.
DUPLIKA is not liable for damages to Users’ or third parties’ equipment resulting from Website use.
Users must maintain their own backups of websites, emails, and access credentials.

15. Responsibility for Comments and Opinions
DUPLIKA is not responsible for the contents of Users’ sites or emails.
It is not liable for decisions based on Website content or for any resulting damages.
DUPLIKA may remove content containing insults, offensive material, excessive advertising, or that is excessively long.

16. Privacy of Personal Information
Protecting Users’ personal data is essential to DUPLIKA, which uses all possible technical, security, and legal means.

17. Intellectual and Industrial Property
All content, including design, domains, brands, texts, graphics, logos, images, icons, software, and services, are protected by intellectual property laws and belong to DUPLIKA or its licensors.
Unauthorized use, copying, reproduction, or distribution is prohibited.
Access to the Website does not grant Users any rights to the intellectual property contained therein.
If Users believe their intellectual property rights are violated, they should immediately notify DUPLIKA.

18. Advertisements and Links
The Website may feature third-party ads and links.
Upon accessing external links, Users are subject to the terms of those third-party sites, for which DUPLIKA is not responsible.
DUPLIKA’s display of ads or links is purely informational and does not imply any relationship with third parties.

19. Website Interruption
DUPLIKA may suspend, interrupt, or modify Website contents at any time, permanently or temporarily, without prior notice.
Access to the Website may be unavailable due to maintenance or technical issues beyond DUPLIKA’s control.
